Terms and Conditions

1. Acceptance of Terms

By accessing or using the Catchball Connect web application ("App"), operated by Catchball World LLC ("Company," "we," "our," or "us"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the App. These Terms constitute a legally binding agreement between you and the Company.

2. Eligibility

You must be at least 18 years of age to create an account and use the App. By registering, you represent and warrant that you are at least 18 years old, that all registration information you submit is truthful and accurate, and that you will maintain the accuracy of such information. The Company reserves the right to terminate accounts that violate this requirement.

3. Account Registration and Security

To access certain features of the App, you must register for an account using Google, Facebook, or email authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. The Company is not liable for any loss or damage arising from your failure to protect your account credentials.

4. User Conduct and Community Standards

By using the App, you agree not to:

• Post, upload, or share content that is defamatory, obscene, harassing, threatening, discriminatory, or otherwise objectionable
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Use the App for any commercial purpose not expressly authorized by the Company (including unauthorized advertising or solicitation)
• Transmit spam, chain letters, or unsolicited communications to other members
• Attempt to gain unauthorized access to other accounts, computer systems, or networks connected to the App
• Upload viruses, malware, or other harmful code
• Scrape, crawl, or use automated means to access the App or collect member data
• Interfere with or disrupt the App's functionality, servers, or networks
• Violate any applicable local, state, national, or international law or regulation
• Bully, intimidate, or harass other members in any form

The Company reserves the right to remove any content and suspend or terminate any account that violates these standards, at our sole discretion and without prior notice.

5. User-Generated Content

You retain ownership of content you create and share on the App (including profile information, photos, videos, discussion posts, business listings, and messages). By posting content on the App, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute your content in connection with operating and promoting the App.

You represent and warrant that you own or have the necessary rights to all content you post, and that your content does not infringe on the intellectual property rights or privacy rights of any third party.

6. Admin Hierarchy and Roles

The App features a multi-tier administrative hierarchy (Club Owner, National Admin, Local League Leader, Team Leader, and sub-roles). Administrators at each level have specific permissions and responsibilities. The Club Owner retains ultimate authority over all administrative decisions, including the ability to grant, modify, or revoke admin privileges at any level. Administrators agree to use their elevated access responsibly and in accordance with these Terms.

7. Member Business Directory

The App may feature a directory of businesses owned by members. Business listings are provided for informational purposes only. The Company does not endorse, guarantee, or assume responsibility for any product, service, or offer provided by listed businesses. Ratings and reviews reflect the opinions of individual members and not the Company. Business owners are solely responsible for the accuracy of their listings and compliance with applicable laws.

8. Advertising

The App may display advertisements from member-owned businesses and third-party advertisers. The Company is not responsible for the content, accuracy, or legality of any advertisements. Advertising does not constitute endorsement by the Company. Advertisers are solely responsible for ensuring their ads comply with applicable laws and regulations.

9. Payments, Donations, and Fees

Certain features of the App involve financial transactions, including donations, sponsorships, membership fees, and merchandise purchases. Payments are processed through third-party providers (currently Zeffy for donations and Shopify for merchandise). By making a payment, you agree to the terms and policies of the applicable payment processor.

All donations are voluntary. Refund policies for merchandise purchases are governed by the Catchball World Shopify store policies. The Company reserves the right to modify fees and payment terms with reasonable notice to affected members.

10. Intellectual Property

The App, including its design, logos, graphics, text, software, and all other content (excluding user-generated content), is the property of Catchball World LLC and is protected by copyright, trademark, and other intellectual property laws. The "Catchball Connect" and "Catchball World" names and logos are trademarks of the Company. You may not use, reproduce, or distribute any Company intellectual property without prior written permission.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY. IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your user-generated content.

14. Assumption of Risk

Catchball is a physical sport. The Company is not responsible for any injuries, accidents, or damages that occur during Catchball practices, games, tournaments, or any other physical activities organized through or discovered via the App. By using the App to find teams, attend events, or participate in activities, you acknowledge and assume all risks associated with physical sports activities.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Fulton County, Georgia. Each party shall bear its own costs and attorneys' fees. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Fulton County, Georgia.

17. Termination

The Company may suspend or terminate your account and access to the App at any time, for any reason, with or without notice, including for violation of these Terms. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) shall survive.

18. Modifications to Terms

The Company reserves the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and the Company regarding your use of the App and supersede all prior agreements and understandings.
